DO I NEED AN ARC REQUEST IF…

Q. Do I need an ARC request for a slight change in paint color?

A. Yes.  Any change in paint color requires an ARC request.

Q. Do I need to make an ARC request if I am painting my house the same color as the existing color?
A. No, you would not need to make an ARC request to paint your house the EXACT same color as the existing color.
Q. Do I need to make an ARC request if I wish to remove trees on my property?
A. Yes, generally you would need to make an ARC request.  The guidelines state:
The removal of any tree with a trunk circumference of 20 inches (20”) at a height of 2 feet (2’) above the ground requires an ARC submission and approval. There are no exceptions for the removal of dead or dying trees – these also require prior approval unless the tree has already fallen. Tree removal requests are normally processed in a matter of days. Homeowners shall submit an ARC request to remove dead trees as soon as the tree is identified as being dead. Excessive pruning may be subject to actions outlined in Section VII, (Violations and West Park Community Association Remedies) if such pruning results in the death of the tree. The removal of any tree in the buffer zone requires prior written approval from the Town of Cary. All stumps should be cut or ground as close to ground level as possible. Leaves and/or other debris to be picked up by the Town of Cary’s waste collection services must not be raked or placed onto ParkScene. All homeowners should ensure that any yard cleanup activities correspond with the Town of Cary’s loose-leaf collection cycle to reduce the amount of time leaf piles impact vehicular traffic throughout the neighborhood. See the Town of Cary website (http://bit.ly/LooseLeafCollectionSchedule) for additional information.
Additionally, if you are planning to remove a dead tree, it is a good idea to notify the Management Company so questions do not arise post-removal.

HOW DO I…

Q. Reserve the clubhouse for private events?

A. Check the calendar for avability and use the reservation form here.

Q. How do I reserve the pool/ tennis court/ playground?

A. These common areas cannot be reserved.  Only the clubhouse can be reserved.
The pool and playground are open to all residents during normal hours.  You can use these facilities for your small gathering, but they cannot be reserved.  The only exception would be a Westpark sponsored event (such as the Rising Kindergarten Summer Social).
The tennis court is first-come, first-serve.  The only exception would be a Westpark sponsored event.

A. Pool keys convey with property sales.  To obtain a replacement pool key, contact our management company.

NOTICE OF RIGHT TO VOLUNTARY MEDIATION – Pursuant to Section 7A-38.3F of the North Carolina General Statutes, all members are hereby informed that you have a right to initiate mediation pursuant to the terms of the statute to try to resolve a dispute with the Association.  Both the homeowner and the Association must agree to mediate the dispute, and each side is responsible for splitting the cost of the mediation, including payment of a professional mediator.  The mediation process is an opportunity to reach an agreement to resolve a dispute – neither side gives up their right to go to court to have a judge resolve the dispute if the parties are not able to reach an agreement through mediation.  The specific process to initiate voluntary mediation is outlined in Section 7A-38.3F of the North Carolina General Statues.
